Who is the Bankruptcy Trustee?
The bankruptcy trustee is a person appointed by the Bankruptcy Court to assist in resolving a bankruptcy case. The trustee has duties to both the “estate” and to the creditors of the estate. The trustee is responsible for making sure the debtor’s property is valued correctly. If the estate has assets over what is allowed by exemptions, the trustee must sell those assets and pay money to the creditors. At the end of the proceedings the trustee also provides an accounting to the Bankruptcy Court. At all times, the trustee is responsible for making sure no fraud is committed by the debtor.
